Terms and Conditions
Commercial booking conditions, service terms, statutory disclosures, and candidate consumer rights
1. Acceptance of Terms & Scope of Services
These Terms and Conditions govern access to and use of dtechinstructortraining.com.au, candidate registrations, Expressions of Interest, in-car dual-control practical mentoring sessions, and instructional training services provided by D-Tech Instructor Training Pty Ltd ("D-Tech", "we", "us", or "our").
By browsing this website, lodging an enquiry, or booking practical mentoring, you agree to comply with these terms, our Privacy Policy, and our Code of Practice. Where accredited vocational training is delivered following RTO registration, student rights are further governed by our registered Student Information Handbook (HBK-DTECH-001).
2. Regulatory Framework & Licensing Disclaimers
- Transport for NSW (TfNSW) Independence: D-Tech delivers training pathways aligned with national standards and TfNSW instructor competencies. Confirmation of vocational competency does not constitute or guarantee the grant of an NSW Motor Vehicle Driving Instructor Licence. The formal granting, renewal, suspension, or refusal of an instructor licence remains the exclusive statutory discretion of Transport for NSW under the Driving Instructors Act 1992 (NSW).
- Candidate Entry Requirements: Candidates are personally responsible for verifying and maintaining their statutory eligibility under TfNSW criteria, including holding a current, unrestricted Australian Class C car licence (minimum 3 of the last 4 years), obtaining commercial medical clearance, passing National Police History checks, and obtaining a valid TfNSW Eligibility Letter.
- Unique Student Identifier: In accordance with the Student Identifiers Act 2014, D-Tech cannot issue any formal Australian Qualifications Framework (AQF) certification or Statement of Attainment without a verified unique student identifier on file.
3. Fees, Prepaid Fee Caps & Milestone Billing
D-Tech strictly complies with Part 4 of the National Vocational Education and Training Regulator (Compliance Standards) Instrument 2025 and Australian Consumer Law regarding fee transparency and protection:
- Mandatory $1,500 Prepaid Fee Cap: D-Tech does not collect or hold more than $1,500 in prepaid fees from any individual prospective student prior to course commencement or service delivery.
- Progress Milestone Instalments: Total course or mentoring fees exceeding $1,500 are partitioned into progressive milestone instalments tied to verifiable delivery stages (e.g., Stage 1: Theory Induction & Diagnostic Review; Stage 2: In-Cabin Practical Instructional Coaching; Stage 3: Assessment Conduct & Final Evaluation).
- Itemised Fee Transparency: All published schedules specify core inclusions (learning guides, portal access, vehicle usage, and standard assessment attempts). Incidental costs (re-assessment fees or supplemental car hire) are published transparently in POL-DTECH-002 before invoicing.
4. In-Car Practical Mentoring & Cancellation Protocols
- 48-Hour Rescheduling Notice: Practical coaching sessions scheduled in dual-control vehicles require a minimum of 48 hours' written notice to reschedule without financial forfeit. Sessions cancelled with less than 48 hours' notice forfeit that scheduled booking fee to cover vehicle allocation and instructor rostering, except in cases of verified illness supported by an official medical certificate.
- In-Cabin Safety & Zero Substance Tolerance: Mentors and assessors enforce an absolute zero-tolerance standard (0.00% Blood Alcohol Concentration and zero illicit or impairing substances). Instructors reserve the statutory and operational authority to terminate any practical session immediately without refund if a candidate displays reckless driving, severe fatigue, non-compliance with safety directions, or abusive behavior.
- 12-Month Enrolment Validity: Practical training packages and enrolment agreements remain active for a maximum period of 12 months from the date of initial commencement. Pacing extensions require formal CEO written approval.
5. Withdrawals, Refunds & Consumer Guarantees
- Full Refund on Provider Default: If D-Tech cancels an intake, ceases delivery, or is unable to provide scheduled training, a 100% full refund of all prepaid monies will be disbursed via EFT within 14 calendar days without any administrative deduction.
- Cooling-off Period & Student Withdrawal: If a candidate withdraws in writing prior to course start and before accessing proprietary learning materials or online portals, tuition fees paid will be refunded less a reasonable $150 administrative processing fee.
- Resource Licensing: Once individual LMS credentials have been issued or proprietary workbook assets downloaded, the designated educational resource fee is non-refundable, except where statutory consumer remedies apply under the Competition and Consumer Act 2010 (Cth) or during Provider Default.
- Debt Recovery: Students agree to pay milestone invoices by the specified due date. Defaulted accounts may be referred to third-party recovery services, with reasonable collection costs recoverable in accordance with NSW law.
6. Intellectual Property & Dispute Resolution
All test route corridor analyses, commentary driving scripts, instructional videos, and curriculum materials remain the intellectual property of D-Tech Instructor Training Pty Ltd. Unauthorised reproduction, commercial resale, or public distribution is strictly prohibited.
Complaints, grievances, and assessment appeals are managed in accordance with the Standards for RTOs under our Complaints & Appeals Procedure (POL-DTECH-001). Internal resolution procedures are free of charge. Where a dispute cannot be resolved internally, candidates have the right to access an independent external mediator (such as the Resolution Institute or NSW Fair Trading).
